Martinez pleads guilty to kidnapping, rape

In a Umatilla County Hermiston Circuit courtroom Friday morning, Alberto Quiroz Martinez pleaded guilty to three charges in a case involving the alleged kidnapping of a Hermiston woman.

Martinez pleaded guilty to one count each of first-degree kidnapping, first-degree rape and first-degree sodomy.

Judge Dan Hill accepted a plea petition, signed by Martinez, with a stipulated sentence of at least 35 years or 420 months in Department of Corrections. Martinez opted for time to spend with his family before his sentence is delivered at 9 a.m. on Dec. 27 at Hermiston Circuit Court.

The 29-year-old is charged with kidnapping his former girlfriend from her workplace on April 26 in Hermiston, and with committing first-degree rape and first-degree sodomy. Martinez allegedly tied up the woman, placed her in the trunk of a vehicle, and took her to a cabin in northern Klamath County. The woman was recovered on May 1 after a stand-off between Martinez and Oregon State Police.

Hill reminded Martinez, visible to the court via a television screen from Umatilla County Jail, that by pleading guilty, he waived his right to a trial and to testifying on his own behalf. Hill also said the proposed sentence would would not be eligible for reduction or early release.

Umatilla County District Attorney Dan Primus has been in discussion with the Klamath County district attorney, who has agreed not to charge or prosecute Martinez.
